- You own your workflows, your data and your connected accounts. We run them for you.
- You pay for the plan you pick. At the monthly run limit, new runs stop until the month resets or you upgrade. We email you at 80 % and at 100 %.
- Do not use OpFlow to spam, break the law or attack anyone. Your workflows act for you, and you answer for what they do.
- AI can be wrong. Check what it writes and what your agents do.
- OpFlow is early software. We work hard to keep schedules on time and we do not promise they always are.
- Cancel any time. Questions go to [email protected].
Terms of Service
The rules for using OpFlow, written to be read. Opscend LLC provides OpFlow; this is the agreement between you and us.
01The agreement
These terms govern your use of OpFlow: the workflow automation service at flow.opscend.net, its API and its MCP server (together, the Service). OpFlow is provided by Opscend LLC, an Illinois limited liability company based in Chicago (Opscend, we, us).
By requesting access, creating an account or using the Service you agree to these terms and to our Privacy Policy. If you use OpFlow for a business, you confirm you can bind that business, and you means the business as well. You must be at least 18.
02Your account
- Sign-up can be limited to invited or approved email addresses. Requesting access does not promise an account.
- Give us accurate details and keep them current.
- Keep your password and API tokens secret. You are responsible for what happens under your account. Tell us at [email protected] if you think it was misused.
- A workspace (organization) has an Owner. The Owner is responsible for who is invited and for the roles they hold.
03Plans, runs and billing
OpFlow has Free, Starter, Growth, Scale and Enterprise plans. The limits and prices of each are on the Pricing page. Enterprise is set by a written agreement.
Runs. A run is one trigger firing, however many steps it has. Retries inside a run are free. Runs are counted for each workspace by calendar month and reset on the 1st.
The limit is a hard stop. When a workspace reaches its monthly run limit, new runs are refused until the month resets or the workspace upgrades. Runs that are refused do not execute. Runs already in progress are not cut off. We email the Owner at 80 % and at 100 %. There is no surprise bill.
Paid plans. A paid plan is a monthly subscription, billed in US dollars in advance through Stripe, and it renews until you cancel. You can upgrade at any time and the change starts immediately, prorated by Stripe. You can downgrade or cancel from Manage billing; the change takes effect at the end of the period you paid for. Taxes are extra where the law requires them.
Price changes. We give 30 days' notice by email before a price changes, and the change applies from your next billing period.
Refunds. Fees are not refundable except where the law requires. If you were charged by mistake, or you never used a paid plan, email [email protected] within 14 days of the charge and we will make it right.
Failed payments. Stripe retries a failed card. If it still fails after notice, we may move the workspace to the Free plan's limits.
04Your workspace and your data
Your Data means your workflows, agents, folders, schedules, the data that moves through your runs, your run history and anything else you put into OpFlow. You own it. You give us a limited license to host, copy, process and send it only as needed to run and secure the Service and as you direct.
You are responsible for having the right to put Your Data into OpFlow, including personal data about your own customers and contacts, and for any notice or consent the law requires. For that personal data you decide why and how it is used, and we process it on your behalf under these terms and the Privacy Policy. A data processing addendum is available on request at [email protected].
You can read your data through the app, the API and the MCP server at any time. When you close an account we handle deletion as the Privacy Policy describes.
OpFlow is not built for protected health information or payment card numbers. Do not send them through the Service unless we have agreed to it in writing.
05Connected apps and credentials
When you connect an app such as Gmail, Notion, Podio, Stripe or RingCentral, you authorize OpFlow to act in it the way you configure your workflows. The API keys and sign-in tokens you provide are stored encrypted and used only to run your workflows and the tests you start.
You must follow each connected service's own terms. Those services are not ours. If one changes, limits you or goes down, workflows that depend on it can fail, and we are not responsible for that. You can revoke access at any time in the connected app or in OpFlow.
06Acceptable use
Do not use OpFlow to:
- break the law or anyone's rights;
- send unsolicited bulk messages, or send email, text or calls without the consent the law requires (for example CAN-SPAM and the TCPA). You are responsible for your messages and your lists;
- harass, defraud or deceive people;
- upload malware, or probe, attack or overload OpFlow or anyone else's systems;
- call or scrape a third-party service in a way its terms forbid;
- get around plan limits, rate limits or security, share logins, or resell OpFlow without our written agreement.
We can block or remove a workflow or an account that breaks these rules, and we may report unlawful activity. We may slow down usage that threatens the Service for other customers.
07AI features
The assistant, the agent builder, agents and AI steps use third-party AI models. What you send them, such as prompts and the data you pass into an AI step, goes to those providers so they can produce a reply. See the Privacy Policy for who they are.
AI output can be wrong, incomplete or the same as what someone else gets. Check it before you rely on it. Agents and tasks you set up act automatically for you, and you are responsible for what they do.
We do not use Your Data to train AI models. Assistant message allowances depend on your plan.
08Availability, schedules and early software
OpFlow is early software and it changes quickly. We work to keep it available, and we do not promise it will be uninterrupted or error free. There is no uptime commitment unless an Enterprise agreement says so.
Schedules and triggers run on a best-effort basis. A run can start late or be skipped during an incident or when a provider or platform limit is hit. Do not rely on OpFlow alone where a late or missed run could cause serious harm, such as safety, emergency or time-critical financial actions. Build your own checks.
We may do maintenance and change features. We give notice before we remove a feature you depend on. Notable changes are in the Changelog.
09Support
Support depends on your plan, as listed on the Pricing page. Everyone can read the Docs, and paid plans can email [email protected].
10Suspension and ending
- You can stop using OpFlow and cancel at any time. Cancelling stops future charges, and you keep access until the end of the period you paid for.
- We may suspend or end an account for a breach of these terms, a payment that stays unpaid after notice, a legal requirement, or a risk to the security of the Service or other customers. When we can, we warn you first.
- If we end a paid plan for any reason other than your breach, we refund the unused part of the period you prepaid.
- Sections that by their nature should continue after the account ends do, including ownership, the disclaimers, the limits of liability and how disputes are handled.
11Our property and your feedback
OpFlow's software, design and name belong to Opscend and its licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these terms. Do not copy it, resell it or reverse engineer it except where the law allows. If you send us feedback, we may use it without owing you anything.
12No warranty
The Service is provided as is and as available. To the fullest extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. Some places do not allow some of these disclaimers, and then they apply only as far as the law lets them.
13Limits of liability
To the fullest extent the law allows, Opscend is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, however caused.
Our total liability for any claim relating to the Service is limited to the greater of what you paid us in the 12 months before the claim or US $100. Nothing in these terms excludes liability that cannot be excluded by law.
14Your responsibility for claims
You will defend and cover us against third-party claims that come from Your Data, from your workflows' actions in connected apps, or from your breach of these terms. We tell you promptly about a claim and let you handle it, and you do not settle it in a way that binds us without our agreement.
15Disputes and governing law
Illinois law governs these terms, without regard to conflict of law rules. Any dispute goes to the state or federal courts in Cook County, Illinois, and you and we both agree to that. Before filing, email [email protected] and give us 30 days to work it out.
16Changes to these terms
We may update these terms. For a material change we give 30 days' notice by email or in the app. If you keep using OpFlow after the date it takes effect, you accept the change. If you do not agree, cancel before then.
17General
These terms and the Privacy Policy are the whole agreement between you and us about the Service. If a part is unenforceable, the rest stays in force. Not enforcing a term is not a waiver of it. You may not assign these terms without our consent; we may assign them with a sale of the business. We send notices to the email on your account, and you send them to [email protected]. A written Enterprise agreement overrides these terms where they differ.
